1. User Information

Who is the controller of your personal data?

EXPLOTACIONES AGRÍCOLAS HERMANOS CHUMBOS, S.L. (hereinafter, the Controller) has created profiles on the social networks Facebook, Instagram, Twitter, LinkedIn, YouTube, Vimeo, and Google+, and is responsible for the processing of the User's personal data carried out on those platforms. This data will be processed in accordance with Regulation (EU) 2016/679 of April 27 (GDPR) and Organic Law 3/2018 of December 5 (LOPDGDD).

Why do we process your personal data?

The purpose of the processing is to maintain a relationship between the User and the Controller, which may include the following operations:

  • Handling requests and inquiries submitted to the Controller.
  • Informing about activities and events organised by the Controller.
  • Informing about products or services offered by the Controller.
  • Interacting through official profiles.

What is the legal basis for processing your personal data?

The legal basis is Article 6.1.a GDPR: the data subject has given consent to the processing of their personal data for one or more specific purposes. By choosing to follow our official profiles, the User provides their consent to the processing of personal data published on their profile.

The User may access the privacy policy of each social network at any time, as well as configure their profile to ensure their privacy.

How long will we keep your personal data?

Data will be retained for as long as the User does not withdraw the consent given, as described in this privacy policy.

To whom do we provide your personal data?

Information provided by the User through the Controller's social media profiles, including personal data, may be published depending on the services used, and could therefore be accessible to other third-party users of those networks. No transfer of personal data to third parties outside the social network is planned, unless strictly necessary for the purposes of the processing, in which case it may be shared with communication-related service providers bound by the required confidentiality and data processor agreements.

What are your rights?

The following rights apply only to information under the Controller's direct control:

  • Right to withdraw consent at any time.
  • Right of access, rectification, portability, and erasure of your data, and the right to limit or object to its processing.
  • Right to file a claim with the supervisory authority ( www.aepd.es)
    • if you consider that the processing does not comply with current regulations.

2. Use of the Profile

The Controller may carry out the following actions:

  • Access to the public information of the User's profile.
  • Publishing on the User's profile any information already published on the Controller's social network.
  • Sending personal and individual messages through the social network's channels.
  • Page status updates published on the User's profile.

The User may always manage their connections, remove content they are no longer interested in, and restrict who can see their connections by accessing their privacy settings.

3. Publications

Once a User follows or joins the Controller's social network, they may publish comments, links, images, photographs, or any other multimedia content supported by the platform. In all cases, the User must be the owner of the published content or hold the necessary intellectual property rights, or have obtained the consent of any third parties involved.

Any publication — whether text, graphics, photographs, videos, or otherwise — that violates morality, ethics, good taste, or decency, or that infringes intellectual or industrial property rights, the right to one's own image, or applicable law, is expressly prohibited. In such cases, the Controller reserves the right to remove the content immediately and without prior notice, and may request the permanent blocking of the User.

The Controller shall not be held responsible for content freely published by a User. Images published on the social network will not be stored in any file by the Controller, but will remain on the social network itself.

4. Minors and Persons with Special Needs

Access to and registration on the Controller's social networks is prohibited for users under 14 years of age. If the User has special needs, the intervention of their legal guardian or representative is required, evidenced by a valid document proving such representation.

The Controller shall be expressly exempt from any liability arising from the use of social networks by minors or persons with special needs. The Controller's social networks do not knowingly collect any personal information from minors; therefore, if the User is a minor, they must not register, use the Controller's social networks, or provide any personal information.
